    Default HP cancelled my order do to pricing error

    On August 5th they had on their site an FX-6120 HP desktop down to $120.00 I even modified it changed the processor to an FX-8150 added a 3GB 7950 ATI card and upgraded the Hard drives and the price still stayed at $120.00. I ordered 2 of them and got an email back about 25 mins later that my order was accepted and its in progress and estimated ship date is August 10th. afew days later after the order I get an email saying they cancelled my order do to pricing error. Thats BS.

    even if it was a pricing error and a glitch in their system with the upgrades then why did my 1st email say my order was accepted ? Cant accept an order and then afterwards decide to decline it cause of a pricing error. and they should honor that price even if it is a pricing error just like any other retailer would do.Click image for larger version.

    Well, as awesome a price as that is, no online retailer is legally obligated to fulfill an order with a price mistake. And most don't. Sears mistakenly priced iPads at $69 last year, guess how many actually shipped to customers at that price? None. Bottom line legally, a price is merely an offer, not an obligation, a retailer can refund and cancel an order for any reason prior to the order shipping. And in their terms of service they state they have the right to cancel an order, so you technically agreed to this once you hit order:


    HP reserves the right to cancel any accepted order prior to delivery at HP's discretion in the event of any pricing error or any material error in connection with your order or other conditions published in the HP Store relevant for your order, or if any further verification of your credit conditions or records so warrants. For the avoidance of doubt, HP will not be responsible for any pricing error or any material error as described above. If you have already made payment and your order is cancelled, HP will issue an appropriate refund or credit to your account, as may be applicable.
    Bottom line, pricing errors happen. If they don't get caught you win, I recommend selecting overnight shipping on any obvious price error and hope it makes it out the door before they realize.

    damn your right if I did the 2 day shipping I probably would have gotten it. I got the cancellation email 4 days after the order. couldnt sleep the 1st night, was so excited.

    No you wouldn't have. If it was a pre-built computer that might have worked but it was never going to happen on a CTO computer. There are a lot of legitimate complaints that people have with HP but this isn't one of them. No online retailer would let this go through and honor the price error. Just last month Adorama listed a $2500 laptop for $160 and tons of us ordered. We all got cancellation emails within a few days. The fact is that all retailers have something like what Andrew posted in their terms of service

    Bah! Yea right, the parts in that computer are worth 1500 or more. Thye are not going to give you 1k for nothing. They can decline any sale they see fit.

    First email was an automatic response you get from any web based retailer when you buy something, would you really belive there is always a human being responding to every order 24/7? A machine does not know if it is a pricing error or not, so the cancellation came after a human rep viewed the custom order.

    Things are different around the world. Around here shops are required to honor the pricing unless it is a clear error. There is no percentage or amount of money that would be the mark of clear error, so it is up to people's judgement. I'd say if you can tell before ordering that the deal is too good to be true then the shop might cancel the order for the same reason.

    There's also other factors, how much money is lost if the products are shipped (for a reseller selling 100 external drives at 10USD loss each might be acceptable where selling 100 computers at 1000USD loss each probably is not). Honoring those deals is a publicity thing too, people talk about both good and bad deals.

    I was there too when that error was up. Don't be greedy. HP gave you a $200 gift coupon with no minimum purchase requirement. The only requirement was that the product that's bought has to be branded "HP". I got the apology and that one use coupon too. Since the day they release these coupons, their IPS monitors were bought out by coupon owners within hours and they had to revise some of its prices and the "real" value of the coupon dropped to approx $120 when it comes to monitors... its a free $200 product.

    Printing & Imaging products did not experience price hikes though.

    Couldn't ask for more.

    Contact them you ordered it and it was paid. If it was on the site for more than 24 hours trade standards say they HAVE to sell it at that price.

    I know some who got a 50" for £70 the same way
